These terms govern your use of the Hyper Tyres website and your purchase of products and services from us. By placing an order, you agree to these terms.
1. About These Terms
These Terms and Conditions ("Terms") apply to all purchases made through www.hypertyres.co.nz ("the Website"), operated by Hyper Tyres Limited ("Hyper Tyres", "we", "us" or "our"), a company registered in New Zealand.
By using our Website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Website or purchase from us.
Nothing in these Terms is intended to limit or override your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other New Zealand legislation that cannot be excluded by agreement.
2. Products and Pricing
All prices displayed on our Website are in New Zealand Dollars (NZD) and include GST (Goods and Services Tax) at the current rate of 15%, unless otherwise stated.
We make every effort to ensure product descriptions, images and prices are accurate. However, we reserve the right to correct any errors. If a pricing error affects your order, we will contact you before processing it and give you the option to proceed at the correct price or cancel.
Product availability is subject to stock levels. If a product you have ordered is out of stock, we will notify you promptly and offer an alternative or a full refund.
3. Placing an Order
When you place an order through our Website, you are making an offer to purchase the selected products and/or services. A binding contract is formed when we send you an order confirmation email.
It is your responsibility to ensure that the tyre size, specifications and quantity you order are correct for your vehicle. If you are unsure, we encourage you to use our Ask Charlie tyre advisor or contact us before ordering.
We reserve the right to refuse or cancel any order at our discretion, including where we suspect fraudulent activity or where an order contains an obvious pricing error.
4. Payment
Payment is required at the time of placing your order. We accept payment via credit card, debit card and other methods available at checkout. All payments are processed securely through Stripe, a PCI-DSS Level 1 certified payment processor.
We do not store your full card details on our servers. Your payment information is transmitted directly to Stripe using industry-standard encryption.
5. Delivery
We offer the following delivery options:
- Installer delivery (free): tyres delivered to your chosen installer from our network of 200+ fitting locations nationwide, typically within 1–3 business days
- Mobile fitting (Auckland): our mobile fitting van delivers and fits your tyres at your home or workplace. Fitting from $10.00 per tyre
- Home delivery ($14.99/tyre): tyres delivered to your residential or commercial address anywhere in New Zealand, typically within 2–4 business days
Delivery timeframes are estimates only and are not guaranteed. We will make reasonable efforts to deliver within the stated timeframes. Delays caused by events outside our control (such as courier disruptions, severe weather, or public holidays) do not constitute a breach of these Terms.
Risk of loss or damage passes to you upon delivery. For installer deliveries, risk passes when the tyres arrive at the installer's premises.
6. Tyre Fitting
Tyre fitting is performed by independent installer partners within our network, or by our own mobile fitting team in Auckland. Fitting charges are displayed at checkout and are in addition to the tyre purchase price.
Our installer partners are independent businesses. While we select installers based on quality standards, we are not liable for the fitting service itself. Any issues with fitting should be raised with the installer directly in the first instance, or contact us and we will assist in resolving the matter.
Fitting appointments are subject to availability. If you need to reschedule, please contact us at least 24 hours before your appointment.
7. Consumer Guarantees
Under the Consumer Guarantees Act 1993, all products we sell come with guarantees that cannot be excluded. These include guarantees that products will be:
- Of acceptable quality
- Fit for their intended purpose
- As described on our Website
- Delivered within a reasonable time
If a product fails to meet these guarantees, you are entitled to a remedy. For more information, please see our Returns Policy.
8. Manufacturer Warranties
Many tyres we sell come with a manufacturer's warranty. The terms and duration of these warranties vary by brand and product. Manufacturer warranty information is provided on the product page where available.
Manufacturer warranties are in addition to (and do not replace) your rights under the Consumer Guarantees Act 1993.
9. Returns and Refunds
Our full returns and refund policy is set out on our Returns Policy page. In summary:
- Faulty or incorrectly supplied products can be returned for a refund, replacement or repair under the Consumer Guarantees Act
- Unfitted tyres in original condition may be returned within 14 days for a refund (less return shipping costs)
- Tyres that have been fitted cannot be returned for change of mind, for safety reasons
10. Website Use
You agree to use our Website only for lawful purposes. You must not:
- Use the Website in any way that breaches any applicable New Zealand law or regulation
- Use automated tools (bots, scrapers) to access or extract data from the Website without our written permission
- Attempt to gain unauthorised access to our systems or interfere with the Website's operation
- Submit false, misleading or fraudulent information
11. Intellectual Property
All content on our Website — including text, images, logos, graphics, videos, and software — is owned by or licensed to Hyper Tyres Limited and is protected by New Zealand and international intellectual property laws. You may not reproduce, distribute or use any content without our prior written consent.
Tyre brand names, logos and product images are the property of their respective manufacturers and are used on our Website for identification purposes only.
12. Limitation of Liability
To the maximum extent permitted by New Zealand law, Hyper Tyres' total liability to you for any claim arising from or related to your use of our Website or purchase of products is limited to the amount you paid for the relevant product or service.
We are not liable for any indirect, consequential, special or incidental loss or damage, including loss of profits, data or business opportunity, except where such exclusion is prohibited by law.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under New Zealand law.
13. Promotions and Discount Codes
From time to time, we may offer promotional discounts or discount codes. Unless otherwise stated, promotions:
- Cannot be combined with other offers or discount codes
- Are valid for a limited time only and may be withdrawn at any time
- Apply to tyre purchases only (not fitting charges or delivery fees) unless specified
- Are limited to one use per customer unless otherwise stated
14. Ask Charlie (AI Tyre Advisor)
Our AI-powered tyre advisor, "Ask Charlie", provides tyre recommendations based on the information you provide. While we strive for accuracy, recommendations are for guidance only and should not be relied upon as professional automotive advice.
You are responsible for verifying that any tyres you purchase are suitable for your vehicle. If you are unsure, we recommend consulting a qualified tyre professional or contacting us directly.
15. Privacy
Your personal information is collected, used and stored in accordance with our Privacy Policy, which forms part of these Terms.
16. Disputes
If you have a dispute with us, please contact us first at [email protected] and we will do our best to resolve it. If we cannot reach a resolution, either party may refer the dispute to the Disputes Tribunal of New Zealand (for claims up to $30,000) or the District Court.
17. Governing Law
These Terms are governed by and construed in accordance with the laws of New Zealand. The New Zealand courts have exclusive jurisdiction over any disputes arising from these Terms.
18. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our Website after changes are posted constitutes acceptance of the updated Terms. We recommend reviewing these Terms periodically.
